Terms of service
These Terms & Conditions ("Terms") apply to all products and services provided by TundraGeek Creations, LLC ("Company," "we," "our," or "us"), including but not limited to custom embroidery services and custom printed products such as stickers, decals, labels, and similar goods (collectively, "Products").
By approving an estimate, submitting artwork, placing an order through our online store, or providing apparel or materials, you ("Customer," "you," or "your") agree to be bound by these Terms.
Scope: Custom vs. Ready-Made Products
These Terms distinguish between custom or made-to-order Products (items produced from your artwork, personalization, or specifications — including custom stickers and custom embroidery) and ready-made Products (finished goods sold as-is). Provisions regarding proofing, artwork, and final sales apply to custom Products. Ready-made Products are covered by our Returns & Exchanges Policy.
Estimates & Pricing
All estimates are valid for thirty (30) days from the date issued.
Final pricing may vary if order details change after estimate approval.
Orders are not confirmed until full payment is received, unless otherwise agreed in writing.
In the event a Product is listed at an incorrect price due to typographical or system error, we reserve the right to cancel the order and issue a full refund.
Payment Terms
Full payment is required prior to production unless otherwise agreed in writing. Orders placed through our online store are paid in full at checkout.
Orders will not enter production or be released until payment is received in full.
Additional fees may apply for rush production or substantial artwork revisions.
Artwork Submission & Intellectual Property Responsibility
You are solely responsible for ensuring you have the legal right to reproduce submitted artwork.
We do not verify intellectual property ownership and assume no liability for infringement claims.
We reserve the right to refuse orders that may infringe intellectual property rights or violate applicable law.
We may perform minor technical adjustments for production preparation (such as cleaning edges, resizing, or adding cut lines). These adjustments do not constitute graphic design services.
We are not responsible for quality issues resulting from low-resolution or poor-quality source files.
Proofing & Approval
A digital proof or mockup will be provided prior to production for custom Products.
Production will not begin until your approval is received. Approval given by email or through electronic means (including responses to proof emails) constitutes written approval.
Up to two (2) rounds of proof revisions are included with your order. Additional revision rounds may incur additional fees.
You are responsible for reviewing spelling, layout, placement, sizing, and colors.
Once approved, the order is final. Changes after approval may incur additional fees and delays.
Production Methods
Embroidery Services:
Embroidery involves machinery and heat processes that carry inherent risks.
Customer-Provided Apparel: We are not responsible for replacement of customer-provided garments damaged during production. If damage occurs, credit will be issued equal to the embroidery cost only.
Apparel Provided by TundraGeek Creations, LLC: Damaged items will be replaced at no cost, subject to availability. Equivalent substitutions may be made if necessary.
Printed Products:
Most printed products are produced through an off-site production partner.
Certain adult-themed designs may be produced in-house with limited material and cut options.
Turnaround Times
Standard production time is approximately 7–10 business days after proof approval and receipt of required materials.
Turnaround times are estimates and not guaranteed.
We are not responsible for delays caused by customer response time, supply shortages, production partner delays, shipping carriers, or events outside our control.
Color, Print & Production Variations
Minor variations in color, thread, ink, alignment, placement, finish, or cut tolerance are inherent in custom production and do not constitute defects. Artwork supplied in RGB color is converted to CMYK for printing, and colors may differ slightly from what appears on screen.
Durability & Use Disclaimer (Printed Products)
Where a product listing states specific durability ratings (such as outdoor life or UV resistance), those ratings are manufacturer specifications provided as-is. Beyond specifications explicitly stated in a product listing or in writing, we make no guarantees that printed products are waterproof, weatherproof, UV-resistant, dishwasher-safe, or suitable for outdoor or vehicle use, and no guarantees are made regarding longevity under environmental exposure or improper installation.
Returns, Refunds & Cancellations
Custom and made-to-order Products are final sale. No returns or refunds will be accepted on custom Products unless an error was made by us that materially deviates from the approved proof.
Ready-made Products may be exchanged in accordance with our Returns & Exchanges Policy.
Manufacturing defects must be reported with photographic evidence within a reasonable timeframe.
Custom orders may be canceled prior to proof approval. Once approved and in production, orders cannot be canceled.
Use of Images for Promotion
You grant permission for us to photograph and use images of finished Products for promotional purposes.
We will not sell or license your logo or artwork to third parties.
Force Majeure
We are not responsible for delays or failure to perform due to events beyond our reasonable control, including supply shortages, production partner delays, shipping carrier delays, natural disasters, outages, labor disruptions, or government actions.
Limitation of Liability
Our liability is limited to the amount paid for the specific order giving rise to the claim.
We are not liable for indirect, incidental, consequential, special, or punitive damages.
For customer-supplied apparel, liability is limited strictly to the embroidery service cost.
Governing Law
These Terms are governed by the laws of the State of Alaska, without regard to conflict-of-law principles.
